About FOI Laws in Africa

What is the Freedom of Information Act (Nigeria)?

Nigeria's Freedom of Information Act 2011 grants citizens the right to request information from any public institution. Public bodies must respond within 7 days. If denied, you can apply to a court for enforcement.

What if my request is denied?

Each country has an appeals process. In Nigeria, you can appeal to the courts. In South Africa (PAIA), you appeal to the Information Regulator or a court. In Kenya, you complain to the Commission on Administrative Justice. In Ghana, you appeal to the Right to Information Commission.

Can private companies be subject to FOI requests?

Generally, FOI laws apply to public bodies (government ministries, departments, agencies). In South Africa, PAIA also partially covers private entities if the information is needed to protect your rights. Nigeria's FOIA only covers public institutions.

Do I need to give a reason for my request?

No — in all four countries, you are not legally required to explain why you want the information. Simply describe what information you need and who holds it.

Tips for Effective FOI Requests

Best Practices

  • Be specific about the information you need — broad requests may be refused
  • Specify the format you want (electronic, printed, etc.)
  • Keep a copy of your request and note the date you sent it
  • Send by registered mail or email with read receipt for proof of delivery
  • If denied, always ask for the specific legal ground for refusal in writing
